These Terms of Service and any terms expressly incorporated herein apply to any access to, or use of, the website https://dataseal.io/, any of its sub-domains, its Services, and constitute your legal agreement with DataSeal Privacy LLC.
By clicking any "Sign up" / "Register" / "Proceed to checkout" button, registering an account, or by using the Services and/or the Website, you: (a) acknowledge that you have read and understand these terms; (b) represent that you are of sound mind and of legal age to enter into a binding agreement (18 years of age or older); and (c) accept and agree to be legally bound by the terms and conditions of these Terms of Service.
If you do not agree to these Terms of Service, do not click any "Sign up" / "Register" / "Proceed to checkout" button, register an account, or use the Services or the Website.
1. Definitions
- "Terms", "Terms of Service" means the terms of service located at https://dataseal.io/terms-of-service.
- "Policy", "Privacy Policy" means the privacy policy located at https://dataseal.io/privacy-policy.
- "Document", means the contents of this page.
- "DataSeal", "Company", "We", "us" means DataSeal Privacy LLC, a company located at 23515 NE Novelty Hill Rd, Ste B221 - 206, Redmond, WA 98053, a distributor of the Services.
- "Website" means the website accessible at https://dataseal.io, including its sub-domains, services, content, and design.
- "Services" means any product offering or service provided by DataSeal Privacy LLC.
- "Subscription" means an automatically recurring billing cycle.
- "Brokers" means any third-party business engaging in information aggregation, data brokerage, and/or owns or operates one or more people search websites.
2. Modifications
DataSeal reserves the right to change, modify or otherwise alter this Document at any time at DataSeal's sole discretion. Any and all modifications shall become effective immediately once posted. You acknowledge you are responsible to keep yourself apprised of any changes and updates to this Document.
3. Communication.
By registering an email with us, we may send you emails from time to time. You may opt-out of receiving further emails at any time by following the unsubscribe link at the bottom of every email we send, updating the notification settings in your user dashboard, or contacting us directly.
Even if you have unsubscribed from our mailing lists, we may still send you required account emails such as but not limited to billing notifications and account security emails (i.e. multi-factor authentication, action activity). If you do not wish to receive these emails, you must request your account be permanently deleted by contacting support.
4. Third-Party Service Providers.
We may use third-party service providers to monitor and analyze the use of our Service.
Google Analytics is a web traffic analytics service that tracks and reports website traffic. The data is shared with other Google services and may be used to contextualize and personalize the ads of its own advertising network.
Stripe is a suite of APIs powering our online payment processing. All payments, payment information, and subscriptions are managed through Stripe's Level 1 PCI compliant payment infrastructure.
Rewardful is an affiliate tracking software that integrates with Stripe to attribute customers back to the affiliate that referred them.
5. Services.
I. Changes to Service
We reserve the to change, amend, or withdraw service at any time at our sole discretion and without notice. This may include restricting access to all or particular users, including registered users.
II. Interruption of Service
You acknowledge that temporary interruptions may occur in the provision of or use of the Service and that such interruptions shall not result in DataSeal having any liability to you or others. This shall not suspend or eliminate your payment obligations to DataSeal or provide you with any refund rights for amounts previously paid to DataSeal.
6. Registration
In order to use certain features on DataSeal, you will be required to register and create an account on the DataSeal website. By registering with DataSeal, you acknowledge and agree to receive email confirming your registration with DataSeal, notices about your account activity as well as promotional marketing of other DataSeal products and services.
I. Account
By having an account with DataSeal, you agree to take full responsibility for maintaining the confidentiality of your account user name, password, and all related activity that occurs under your account user name. If you violate these terms, the Company may, at its sole discretion, terminate your account and restrict your access to DataSeal. In cases of subscription access, we will charge your applicable credit card according to the pricing and frequency described at the time of subscriptions sign-up and you agree to accept these charges. In the event payment to DataSeal is denied or declined, the subscription access rights may be terminated at DataSeal's sole discretion.
II. Authorized Agent
By purchasing and maintaining an active Subscription, you agree to designate and appoint DataSeal to represent you as your authorized agent to act on your behalf for the purposes of (i) submitting personal information opt out, suppression and removal requests to Brokers, (ii) communicating on your behalf with Brokers, (iii) signing documents regarding the opt out, suppression and removal requests, (iv) creating and closing accounts with Brokers, (vi) exercising your rights under any U.S. or State data privacy laws, including but not limited to the California Consumer Privacy Act and the Nevada Privacy Law, and (vii) communicating on your behalf with government agencies such as the FTC for the purpose of submitting complaints against Brokers not complying with opt out, suppression and removal requests.
By creating an account, you hereby revoke previous agreements with any company granted permission to act as my authorized agent when it comes to exercising my data rights and performing the authorized agent activities described herein.
DataSeal's designation and appointment as your authorized agent will continue in full force until your Subscription is canceled by you or by DataSeal.
III. Suspension; Termination
We may, at our sole discretion, with or without notice and at any time, temporarily suspend or permanently terminate your access to a portion of or all of the Services. Such an action would constitute a withdrawal, cancellation, or annulment of any Power of Attorney, including our appointment as your authorized agent, or any authorizations related thereto, that may have been granted during the provision of the Services. Such an withdrawl, cancellation, or annulment will itself be reinstated upon reinstatement of the Services.
You have the right to request we terminate your Subscription and access to the Services at any time by providing to us a written notice of your intent to terminate ("Termination Request") including the future date ("Termination Date") on which we should process your request. You acknowledge that on the Termination Date, your license to utilize the Services will cease immediately and you shall no longer have rights to the same. If your Termination Request does not include a Termination Date, then the Termination Date will be deemed the date we received the Termination Request. Following the Termination Date, you agree to immediately stop utilizing the Services. You agree and acknowledge that following the Termination Date, we shall have no obligation to maintain, provide to you, or recover any of the data or content you have uploaded, and we may immediately delete the same.
In the event of a suspension or termination, pursuant to Section (7.IV) "Payments", we shall have no obligation to provide you with a full or partial refund of any Fees you have paid, as under these circumstances all Fees paid are final and non-refundable.
7. Payments.
All DataSeal payments are managed through Stripe. Valid payment methods include a credit card, debit card, or e-wallet. All payment information stored for the purpose of automatic charges are stored in Stripe's secure PCI-compliant vault. We are not responsible for the processing of any payments and shall not be held liable for any matter in connection therewith.
I. Subscriptions
You agree to be charged in-advance and on a recurring basis until you or DataSeal suspends or terminates your Subscription. Unless terminated, at the end of each billing-cycle your Subscription will automatically renew under the exact same terms and conditions. If we unsuccessfully attempt to charge a recurring payment to a payment method, we may suspend your Subscription and access to Services until a new valid payment method is added and successfully charged.
II. Discounts and Promotions
We may, from time to time, offer discounts or promotions which may be governed by rules separate and apart from these Terms. If the rules for any discount or promotion conflict with these Terms, the rules of the discount or promotion will prevail.
III. Fee Changes
We reserve the right, at any time and at our sole discretion, to change any fees, prices, or plans. You will always be notified at least thirty-days in advance ("Notice Period") of any price change and will have the opportunity to modify your Subscription before the modified fee, price, or plan goes into effect. If you do not take any action within the Notice Period, you are agreeing to have your Subscription amount updated and to be charged a recurring and non-refundable amount equal to the new fee or price.
IV. Refunds
You acknowledge that all payments to DataSeal are final and non-refundable, except at the sole discretion of DataSeal. If you would like to request a refund, we may offer a partial or full refund depending on factors including but not limited to how long you have utilized the Services, the circumstances that led to your request, and/or the number of previous refunds you have requested.
8. Support.
You may contact us at any time and for any reason pertaining to the Website or Services. You acknowledge that while we endeavor to respond to all communications within 24 hours, the actual response time may vary depending on the current request volume.
I. Error Reporting and Feedback
You may contact us at any time to communicate errors, feedback, ideas, suggestions, or concerns regarding the use or improvement of the Website or the Services. In doing so, you grant us a free-of-charge, irrevocable, non-exclusive, transferable right to use, modify, share, distribute and communicate such feedback for any and all commercial or non-commercial purposes and free of any obligation of attribute. You warrant that any such feedback you communicated to us is not subject to any license, patent, intellectual property rights, or any other third-party rights.
9. Affiliates.
DataSeal sponsors affiliates who would like to endorse our Services and share in the revenue generated by customers they send to us. We work with creators to create advertisement creatives for DataSeal, but are not liable for or endorse any other content the affiliate has created.
10. Privacy Policy.
We respect your privacy. Please refer to our privacy policy which is incorporated by reference into these Terms, and which explains how we collect, use, store, and disclose information that relates to your privacy.
11. Intellectual Property Rights.
(a) The term ("DataSeal Property") means all programs, files, systems, documentation, information, content, graphics, page layouts, service designs, user interfaces utilized or provided by DataSeal, work product produced by DataSeal, and derivative works of any of the foregoing, including, without limitation, web services made available to you by DataSeal, any HTML programming performed as part of providing you with Service and any other special programs, functionalities, interfaces and other work product, ideas, concepts or techniques which DataSeal may develop, use or rely upon in providing the Service to you.
(b) All DataSeal Property shall be and will remain the property of DataSeal.
(c) DataSeal shall be the sole and exclusive owner of all patents, copyrights, trademarks, trade secrets and other intellectual property rights regarding DataSeal Property and the Service.
12. Limited License Permitted Use.
You are granted personal, non-transferable and nonexclusive rights to access the Service, in strict accordance with these Terms. Certain portions of the Service are only available via license with use rights that are based upon subscription access.
(a) Your use of the Service will comply with all applicable federal, state, local and foreign laws, statutes, rules and regulations ("Laws"), including Laws regarding telemarketing, email, facsimile marketing and customer solicitation.
DataSeal reserves the right to deny access to any user or group of users to the DataSeal Service, at its sole discretion, at any time, and for any reason or no reason. DataSeal reserves the right to remove any feature from the Service at any time and for any or no reason.
13. Limitations on Use.
(a) Unless specifically authorized in advance and in writing by DataSeal, you will not share, sell, transfer or otherwise make the Service available to any third person or entity and you will use your best efforts to prevent the misuse or unauthorized use of the Service by any third person or entity.
(b) You will not name or refer to DataSeal in any of your advertisements or promotional or marketing materials without prior written permission from the Company.
(c) Without the Company's written permission, you shall not duplicate, download, publish, modify, create derivative or otherwise distribute the Services for any commercial use, or for any purpose other than as described in these Terms. You acknowledge that the Company owns and retains all proprietary to material contained on the Service, including trademarks, content, and other proprietary content.
(d) You shall not use the Service in any manner that harasses, invades the privacy of or harms a person in any way.
(e) You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy DataSeal web pages or the content contained thereon or for any other unauthorized purpose without the Company's prior expressed written permission. You agree that you will not copy, reproduce, alter, modify, create derivative works from, or publicly display any content (except for your own personal, non-commercial use) from the Service without the prior expressed written permission from the Company.
(f) You agree that you shall not use the Service in violation of any international, federal, state, or local Law, rule or regulation, whether now existing or enacted in the future, or in any manner that would cause the DataSeal to violate any such Laws, rules, or regulations.
(g) You understand and acknowledge that when you register for the DataSeal Service, you agree to provide and maintain accurate, current, and complete information. In the event you provide any information that is inaccurate, not current, or incomplete, DataSeal has the right to suspend or terminate your access and use of any and all Services.
14. Third-Party Content.
In using our Services, you may view content provided by third parties, including links to web pages of such parties ("Third-Party Content"). We do not control, endorse or adopt any Third-Party Content and shall have no responsibility for Third-Party Content, including without limitation material that may be misleading, incomplete, erroneous, offensive, indecent or otherwise objectionable. In addition, your business dealings or correspondence with such third parties are solely between you and the third parties. We are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings, and you understand that your use of Third-Party Content, and your interactions with third parties, is at your own risk.
15. Indemnification.
You shall indemnify, defend and hold harmless DataSeal, its stockholders, directors, officers, employees, independent contractors and agents against any claim, demand, loss, liability, damage, injury cost or expense (including attorneys' fees and legal costs) which arises, directly or indirectly, out of your act or omission with respect to the Services or any violation of the Agreement or any violation of Laws.
I. Disclaimer of Warranties
DATASEAL DOES NOT PROMISE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT IT WILL PROVIDE SPECIFIC RESULTS FROM USE OF THE SERVICE OR ANY DATA, SEARCH, OR LINK ON IT, OR THAT THE INFORMATION ON THE SERVICE IS COMPLETE OR ACCURATE. THE COMPANY SHALL NOT BE HELD RESPONSIBLE FOR ANY ERRORS OR OMISSIONS ON THE SERVICE OR PRODUCED BY SECONDARY DISSEMINATION OF INFORMATION ON THE SERVICE. THE SERVICE AND ITS DATA ARE DELIVERED ON AN "AS-IS" AND "AS- AVAILABLE" BASIS. THE COMPANY CANNOT ENSURE THAT FILES YOU DOWNLOAD FROM THE SERVICE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SERVICE OR THE DATA, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, AND PUNITIVE AND CONSEQUENTIAL DAMAGES.
The Company disclaims any and all liability for the acts, omissions, and conduct of any third- party users, the Service users, advertisers, and/or sponsors on the Service, in connection with the Service, or otherwise related to your use of the Service. The Company is not responsible for the products, services, actions, or failure to act of any third party in connection with or referenced on the Service.
II. Disclaimer of Damages
IN NO EVENT WILL WE, OUR AFFILIATES AND THEIR RESPECTIVE SHAREHOLDERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, ATTORNEYS, AGENTS, REPRESENTATIVES, SUPPLIERS OR CONTRACTORS BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL OR SIMILAR DAMAGES OR LIABILITIES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, INFORMATION, OR FINANCIAL BENEFIT) ARISING OUT OF OR IN CONNECTION WITH THE SITE, THE SERVICES, ANY PERFORMANCE OR NON-PERFORMANCE OF THE SERVICES, OR ANY OTHER PRODUCT, SERVICE OR OTHER ITEM PROVIDED BY OR ON BEHALF OF US, WHETHER UNDER CONTRACT, STATUTE, STRICT LIABILITY OR OTHER THEORY (INCLUDING, FOR AVOIDANCE OF DOUBT, ANY NEGLIGENCE OF OURS), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
III. Limitation of Liability
DataSeal will not be liable for any claim, demand, loss, liability, damage, injuries, cost or expense (including reasonable attorneys' fees and legal costs), whether general, direct, special, incidental, consequential or other damage caused in whole or in part or directly or indirectly by any use or misuse of the Service or any alleged or actual failure by DataSeal to comply with the Terms of the Agreement, whether or not any such damages were foreseeable or whether DataSeal was advised of the possibility of such damages. DataSeal's maximum liability will not exceed the amount you paid DataSeal under the Agreement within the 12 months preceding the event that gave rise to DataSeal's liability.
16. Miscellaneous.
Governing Law; Jurisdiction. This Agreement shall be governed by and construed under the Laws of the State of Washington without regard for the principles of conflicts of Law of that State or any other state. Any litigation or other dispute relating to or arising under the Agreement shall only be brought in the state or federal courts located in King County, Washington and you agree to submit to the exclusive jurisdiction of those courts and waive any objections to the venue of any such proceeding in those courts.

No Assignment By You. You may not assign your rights or obligations under this Agreement to any other person or entity without the prior written consent of DataSeal, whether by operation of law or otherwise, and any attempt to do so shall be void.
Entire Agreement; Amendment or Waiver. This Agreement contains the entire understanding between you and DataSeal and supersedes any prior understandings or agreements, oral or written, relating to the subject matter of the Agreement. The Agreement may only be amended by a document signed by you and DataSeal. No waiver of any breach of the Agreement shall be deemed a waiver of a future breach, whether of a similar or different nature, and no waiver shall be effective unless in writing signed by the waiving party.
